Terms of Service

These Terms of Service ("Terms") govern your use of Addison, a booking and practice management platform operated by Mayhem Labs Limited ("Addison," "we," "us," or "our"). By creating an account or using Addison, you agree to these Terms.

If you are using Addison on behalf of a business or organisation, you confirm that you have authority to bind that entity to these Terms.

1. The Service

Addison provides scheduling, booking, and practice management tools for mental health practitioners. We offer the Service on a subscription basis and will use reasonable efforts to keep it available, reliable, and up to date.

We may update or change features of the Service from time to time. Where a change materially affects your use of the Service, we will give you reasonable notice.

2. Your Account

You are responsible for:

  • Keeping your login credentials secure and confidential
  • All activity that occurs under your account
  • Ensuring anyone you authorise to use your account complies with these Terms

3. Acceptable Use

You must use Addison lawfully and in good faith. You must not:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service or its underlying systems
  • Transmit or store content that infringes the rights of any third party
  • Resell or commercially exploit the Service without our written consent
  • Do anything that disrupts or impairs the Service for other users

4. Your Data

You own the data you enter into Addison. We do not sell your data or use it for purposes unrelated to providing the Service.

By using Addison, you grant us a limited licence to store and process your data solely to provide, maintain, and improve the Service. We may generate anonymised, aggregated usage data for internal analytics — this will never identify you or your clients.

You are responsible for ensuring that any client information you enter into Addison has been collected lawfully and with appropriate consent. Please refer to our Privacy Policy for full details on how we handle data.

5. Subscription and Payment

Addison is offered on a monthly subscription basis. Fees are charged in New Zealand dollars and are exclusive of GST where applicable.

Payments are processed securely by Stripe. We do not store your card details. By providing payment information, you authorise us to charge the applicable subscription fee on a recurring monthly basis.

We may update our pricing from time to time. We will give you at least 30 days' notice of any price change. If you do not wish to continue at the new price, you may cancel before the change takes effect.

6. Cancellation

You may cancel your subscription at any time from within your account settings. Cancellation takes effect at the end of your current billing period — you will retain access until then. We do not offer refunds for partial months.

On cancellation, you may request an export of your data within 30 days. After that period, we may delete your data in accordance with our Privacy Policy.

7. Intellectual Property

Addison and all its underlying software, design, and content are owned by us or our licensors. These Terms do not transfer any ownership rights to you — you receive a limited, non-exclusive right to use the Service during your subscription.

If you share feedback or suggestions with us, we may use that feedback to improve the Service without any obligation to you.

8. Availability and Warranties

We work hard to keep Addison available and reliable, but we cannot guarantee uninterrupted or error-free service. Scheduled maintenance, third-party outages, or events outside our reasonable control may affect availability.

To the maximum extent permitted by law, the Service is provided "as is." We do not warrant that Addison will meet every specific requirement or be suitable for any particular purpose. Nothing in these Terms excludes any guarantee or right that cannot lawfully be excluded.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you in any 12-month period is limited to the fees you paid to us during that period. We are not liable for any indirect, consequential, or incidental loss, including loss of data, revenue, or business opportunity.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

10. Confidentiality

Each party agrees to keep the other's confidential information secure and not to disclose it to third parties, except as required to provide or use the Service or as required by law.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or via the platform before changes take effect. Continued use of Addison after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.
